III. General information on data processing

1. Scope of the processing of personal data

We process personal data in performing the tasks assigned to LUNG. Personal data are also processed when performing tasks that are directly related to the performance of the tasks assigned to LUNG. This applies, for example, to LUNG acting as a party to a civil-law contract when procuring necessary goods and services, or as an employer. When recovery data are reported that are processed by third parties (other ringing centres or project databases), the finder's name and e-mail address are passed on together with the recovery data so that the finder can be informed in return. Beyond this, personal data are as a rule processed only with the user's consent.

2. Legal basis for the processing of personal data

Insofar as we obtain the consent of the data subject for processing operations involving personal data, Art. 6(1)(a) of the EU General Data Protection Regulation (GDPR) serves as the legal basis.

For the processing of personal data that is necessary for the performance of a contract to which the data subject is party, Art. 6(1)(b) GDPR serves as the legal basis. This also applies to processing operations that are necessary in order to take steps prior to entering into a contract.

Insofar as the processing of personal data is necessary for compliance with a legal obligation to which we are subject, Art. 6(1)(c) GDPR serves as the legal basis.

In the event that vital interests of the data subject or of another natural person make the processing of personal data necessary, Art. 6(1)(d) GDPR serves as the legal basis.

If the processing is necessary to safeguard a legitimate interest of ours or of a third party, and the interests, fundamental rights and fundamental freedoms of the data subject do not override the former interest, Art. 6(1)(f) GDPR serves as the legal basis for the processing.

3. Data erasure and storage period

The personal data of the data subject are erased or blocked as soon as the purpose of storage no longer applies. Data may also be stored beyond this if this has been provided for by the European or national legislator in EU regulations, laws or other provisions to which the controller is subject. The data are also blocked or erased when a storage period prescribed by the aforementioned standards expires, unless further storage of the data is necessary for the conclusion or performance of a contract.

4. Rights of data subjects

LUNG is responsible for the processing of personal data both in the performance of public tasks and as a party to civil-law contracts. Data subjects therefore have the following rights under the GDPR:

a) Right of access – Art. 15 GDPR

The right of access gives data subjects comprehensive insight into the data concerning them and into certain other important criteria, such as the purposes of processing or the storage period. The exceptions to this right laid down in § 34 BDSG apply.

b) Right to rectification – Art. 16 GDPR

The right to rectification gives data subjects the possibility of having inaccurate personal data concerning them corrected.

c) Right to erasure – Art. 17 GDPR

The right to erasure gives data subjects the possibility of having data erased by the controller. However, this is only possible if the personal data concerning them are no longer necessary, are being processed unlawfully, or if consent to such processing has been withdrawn. The exceptions to this right laid down in § 35 BDSG apply.

d) Right to restriction of processing – Art. 18 GDPR

The right to restriction of processing gives data subjects the possibility of preventing further processing of the personal data concerning them for the time being. A restriction applies above all while the exercise of other rights by the data subject is being examined.

e) Right to data portability – Art. 20 GDPR

The right to data portability gives data subjects the possibility of receiving the personal data concerning them from the controller in a commonly used, machine-readable format, in order to have them transmitted to another controller if necessary. Under Art. 20(3), second sentence, GDPR, however, this right does not apply where the data processing serves the performance of public tasks. At LUNG, this is only not the case where personal data are processed for fiscal purposes.

f) Right to object – Art. 21 GDPR

The right to object gives data subjects the possibility, in a particular situation, of objecting to the further processing of their personal data insofar as this is justified by the performance of public tasks or by public or private interests. Under § 36 BDSG, this right does not apply if a public body is obliged by law to carry out the processing.

5. Other information

With regard to data processing by LUNG, there is a right to lodge a complaint with a supervisory authority. This is the State Commissioner for Data Protection and Freedom of Information of Mecklenburg-Vorpommern, Werderstraße 74 a, 19055 Schwerin.
